TikTok Defends Itself Against US Government in Legal Battle

TikTok likens itself to American news institutions with foreign control. The Justice Department is challenging TikTok's First Amendment protections. TikTok and the government's discussions do not result in an agreement.

The Justice Department has previously contended that TikTok, its China-based parent firm ByteDance, and its worldwide and US divisions should not be accorded First Amendment protection owing to their foreign ownership and operations.


In response, TikTok's legal team underlined the importance of the First Amendment in their fight against the rule, which requires ByteDance to sell TikTok to an approved bidder or face a ban.


TikTok's attorneys drew parallels between the platform and well-known news companies such as Politico and Business Insider, both owned by German publisher Axel Springer SE, and Fortune, owned by Thai tycoon Chatchaval Jiaravanon.


They contended that American enterprises with foreign ownership, such as these news sites, do not lose their First Amendment rights, calling into doubt the government's definition of protected speech.


Despite discussions between the Biden administration and TikTok to address national security concerns, no agreement was reached. The government raised issues about data transfers between TikTok employees and ByteDance engineers in China, deeming TikTok's proposed solutions insufficient.


TikTok's legal team countered that the government's concerns were not adequately addressed during negotiations and disputed the government's claims about the proposed agreement's shortcomings.


As the court battle continues, the Department of Justice has asked to put secret information under seal, underlining the gravity of the situation. TikTok has denied these requests.


Oral arguments for the case are scheduled to begin on September 16.
